House Bill 2766 enacted by the Legislature of the State of Arizona changed a number of landlord notification procedures involving properties under foreclosure. Landlords are now required to provide tenants with 90 days advance written notice of the date, time and place of the sale of the foreclosed property. In the absence of such notice, a tenant may recover the greater of actual damages or one month’s rent plus the amount of the security deposit and reasonable attorney fees if the landlord fails to provide proper notice.
